General provisions
1.1. This document is the official proposal (public offer) of ФОП Знак В.В. (the Seller) to conclude a distance contract for the sale of goods in accordance with Articles 633, 641 and 642 of the Civil Code of Ukraine and the Laws of Ukraine “On Consumer Protection” and “On Electronic Commerce”.
1.2. Placing an order on the newsuper.shop website or by telephone constitutes full and unconditional acceptance of the terms of this offer.
1.3. The Seller may amend the terms of the offer. A new version takes effect on the day it is published on the website and does not apply to orders placed earlier.
Definitions
Website — the newsuper.shop online store.
Goods — lighting products, electrical products and related goods presented on the Website.
Buyer — a natural or legal person who has placed an order.
Order — a request to purchase goods through the Website or by telephone, stating the delivery and payment method.
Subject of the contract
3.1. The Seller undertakes to transfer the goods into the Buyer’s ownership, and the Buyer to accept and pay for them on the terms of this offer.
3.2. Information about the goods (name, characteristics, price, availability) is given in the product card. The colour in an image may differ slightly from the actual colour; the technical characteristics take precedence.
Placing an order
4.1. The Buyer places an order through the basket on the Website or by telephone +380 95 382 37 75, giving a name, a contact telephone number, an email address where needed, and the delivery and payment method.
4.2. The contract is concluded when the Seller confirms the order — by telephone, SMS or messenger.
4.3. The Seller may decline to confirm an order if the goods are out of stock, an error is found in the price, or the Buyer does not respond to confirmation requests for 3 working days.
Price of the goods
5.1. Prices are stated in hryvnias; they are valid at the time the order is placed and do not change once it is confirmed.
5.2. The price does not include delivery unless the terms on the “Delivery and payment” page provide otherwise (free delivery from 3 000 ₴).
5.3. For goods sold by length the price is per 1 metre; the cost is calculated on the actual length.
Payment
6.1. Payment methods: by bank card online through the payment service [заповнити]; cash on delivery; bank transfer against an invoice for business entities.
6.2. For goods to order and for orders over 5 000 ₴ the Seller may require full or partial prepayment.
6.3. A payment document is provided in accordance with the legislation of Ukraine.
Delivery
7.1. Delivery is by the carriers Nova Poshta and Ukrposhta or by collection from the Seller’s warehouse. Goods in stock are dispatched within 1–2 working days of confirmation.
7.2. The risk of accidental damage to the goods passes to the Buyer on receipt of the parcel. The Buyer must inspect the parcel on receipt and, if it is damaged, draw up a report with the carrier’s representative.

Returns and exchange
8.1. The Buyer may return or exchange goods of proper quality within 14 days of receipt in accordance with the Law of Ukraine “On Consumer Protection”, provided the goods have not been used and their appearance, packaging and full set are intact.
8.2. Goods of proper quality on the list approved by the Cabinet of Ministers of Ukraine are not returnable, in particular goods sold by length (strip, neon, cable, profile) cut to the Buyer’s size.
8.3. Funds are refunded by the same method as the payment within 7 days of the Seller receiving the goods.
Warranty
9.1. The warranty period is 12 months from the date of sale unless the manufacturer has set a different period stated in the product card or the warranty card.
9.2. The warranty does not cover defects caused by breach of the installation or operating rules, connection to the wrong voltage, mechanical damage or self-repair.
9.3. The warranty service procedure is set out on the “Warranty and returns” page.
Liability of the parties
10.1. The Seller is not liable for the impossibility of using the goods for reasons beyond its control, including the goods not meeting the Buyer’s expectations where they conform to the stated characteristics.
10.2. The Seller is not liable for damage caused by incorrect installation or connection of the goods by the Buyer or third parties.
10.3. The parties are released from liability for non-performance due to force majeure, including hostilities, power outages and suspension of carriers’ operations.
Personal data
11.1. By placing an order, the Buyer consents to the processing of their personal data (name, telephone, email, delivery address) for the performance of the contract in accordance with the Law of Ukraine “On Personal Data Protection”.
11.2. The data processing procedure is set out in the Privacy Policy on the Website.
Other terms
12.1. Disputes are resolved by negotiation and, failing agreement, in court in accordance with the legislation of Ukraine.
12.2. The offer is valid from its publication on the Website until withdrawn by the Seller.
